AGREEMENT AND INSURANCE: The person or organization entering into this agreement with the School District for the use of facilities and/or equipment described above certifies that the information given in this application is current. The undersigned further states that he/she has the authority to make this application for the applicant and agrees that the applicant will observe all rules and regulations. The applicant further agrees to reimburse the School District for any damage arising from the applicant’s use of said facilities. The organization is responsible for ensuring all participants follow district policies, staying in rental areas, and using only rental equipment that was agreed upon in this rental agreement. The organization must submit a copy of organizational liability Insurance. Any accident involving injury to participants or damages to facilities or equipment occurring during the use of facilities or equipment will be reported to district authorities immediately. The User agrees to defend, indemnify and hold harmless Concord Community Schools, its boards, employees, and representatives from any and all claims, actions, suits, judgments and expenses including claims, costs, attorney fees and damages in connection with its activities resulting in loss of life, bodily or personal injury,product liability claims and/or damage to property arising from or out of the use by the user or its agents, members, partners, associates, employees, or any portion of the School District.
The User shall, at its own expense, keep in full force and effect until the cessation of its activity, a commercial general liability (CGL) insurance policy having limits of not less than One Million Dollars ($1,000,000) for each occurrence and in the aggregate combined single limits for bodily injury,
personal injury and property damage. In addition, the policy shall name the School District as an Additional Insured on the policy. The user provides the school district evidence of in force coverage with a Certificate of Insurance prior to the facility use. Insurance requirements can be waived for low risk activities and short term events.
